DUI - DRIVER'S LICENSE SUSPENSION, REVERSED
The Department of Public Safety (DPS) revoked client's license following an administrative hearing. Luke Anthony appealed and the Court found that DPS had violated the licensee's Due Process Rights.
DUI - DRIVER'S LICENSE SUSPENSION, REVERSED
DPS appeal where Luke showed that driver was stopped illegally (for driving on a fog line). This improper stop resulted in the suppression of the DUI stop. Driver's license was restored.
POSSESSION OF DRUGS/DESTROYING EVIDENCE, CASE DISMISSED
An officer sees a suspicious car and follows for several minutes, eventually resulting in a stop that leads to drug charges. Luke Anthony files a motion to suppress evidence based on lack of probable cause for the stop. On the day of the hearing, the State dismissed all charges.
POSSESSION OF DRUG PARAPHERNALIA/ALCOHOL BY PERSON UNDER 21,
CASE DISMISSED
OSU student is reported by Residential Adviser to have Marijuana in dorm room. Police ask to search and are denied. Police obtain warrant but fail to ask Judge for Night Time service. Luke Anthony files Motion to Suppress evidence based on improper Night Time service. On day of hearing, State moves to dismiss all charges.
DRUGS FOUND IN HOME, ALL EVIDENCE SUPPRESSED
Officers pulled over a motorist that had marijuana in her possession, and she told them she got it from a certain house. Officers responded to the house and encountered S.V., who admitted that there was contraband in his home. The officers searched the home and arrested S.V. Luke Anthony suppressed the search and all evidence based upon the officer’s illegal entry to the home.
DRUGS FOUND IN CAR, CASE DISMISSED
A trooper encountered a suspicious acting couple and called in a drug dog to search car. Luke Anthony filed a motion to suppress all evidence based off of a bad dog search. The state dismissed all charges the day of the hearing on Luke’s motion.
DRUGS SEEN BY OFFICER WHEN RESPONDING TO A LOUD NOISE COMPLAINT,
CASE DISMISSED
An officer responded to a loud noise complaint, and when the door was answered, an officer saw marijuana just inside the doorway. Luke’s motion to suppress evidence sustained by the Court.
DRUGS FOUND IN CAR, PASSENGER BLAMED BY DRIVER, CASE DISMISSED
A trooper pulled over two men in a car and found drugs. The driver blamed the passenger. The passenger hired Luke Anthony. The prosecutor dismissed the day of preliminary hearing.
DUI ON BOAT, CASE DISMISSED
Trooper pulled over boat for towing after sunset. After motion to suppress hearing, all charges dismissed by the Judge.
OBTAINING CATTLE BY FALSE PRETENSES, CASE DISMISSED
After a lengthy investigation, man is charged with taking title to hundreds of thousands of dollars worth of cattle by false pretenses. Luke Anthony's demurrer was sustained, and all charges dismissed by the Court.
DRUGS FOUND IN HOME, CHARGES DISMISSED/REDUCED
Officers are searching a home with a search warrant. Defendant comes home while they are searching house. Arrested and charged with Possession of CDS and Paraphernalia. Luke Anthony gets prosecutor to agree to dismiss all drug charges, leaving only a public intoxication charge.
DUI - DRIVER'S LICENSE SUSPENSION, REVERSED
After a DUI arrest and blowing 0.15 on a breath test, the Oklahoma Department of Public Safety suspended a man's license to drive. Luke Anthony had two hearings, which resulted in a reversal of the Order revoking his driver's license.
DRUGS FOUND IN HOME, ALL CHARGES DISMISSED
After police searched a home and discovered drugs and firearms the state filed six charges against a man. Luke Anthony's representation led the prosecutor to dismiss all charges.
CONSPIRACY TO COMMIT FELONY, CHARGES DISMISSED
Police use a confidential informant to purchase crack cocaine. Investigation implicates a man as a conspirator. Prosecutor dismissed all charges on the day of hearing.
POSSESSION OF LIQUOR WITH INTENT TO SELL
After a bar raid by local police, bar manager is charged with possession of liquor with intent to sell. Luke Anthony files a demurrer, and the State drops all charges.
POSSESSION OF DRUGS WITHIN 1,000 FEET OF DAYCARE, CASE DISMISSED
After police dig in trash and get evidence for a search warrant, they charge woman with felony possession of drugs. State of Oklahoma dismisses all charges the day of hearing.
FAILURE TO REPORT ABUSE, CHARGES DISMISSED
State charged a daycare manager with failure to report abuse. Luke Anthony files a demurrer. After a hearing Judge sustains Luke's demurrer, and all charges are dismissed.
PANDERING, CHARGES DISMISSED
After being charged with pandering, man hires Luke Anthony. Luke files a motion to suppress evidence. State dismisses the day of the hearing on the motion.
POSSESSION OF METH, CHARGES DISMISSED
Following a traffic stop, man is arrested for possession of CDS. State later agrees to dismiss charges.
